1. Agreement to Terms

By accessing or using GenPixy's services ("Services"), you agree to be bound by these Terms of Service ("Terms") and our Refund Policy. If you disagree with any part of these terms or the Refund Policy, you may not access the Services. The Refund Policy is available at www.genpixy.com/docs/legal/refund-policy.

2. Description of Services

GenPixy provides DrawGen, an AI video maker that turns text topics into narrated explainer videos. Our Services may change over time and we reserve the right to modify, suspend, or discontinue any part of the Services at any time.

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You must be at least 18 years old to use our Services
• You are responsible for maintaining the security of your account credentials

3.2 Account Restrictions

• One person may not maintain multiple accounts
• You may not share your account with others
• You may not sell, transfer, or assign your account

4. User Responsibilities

You agree to:

• Use the Services in compliance with all applicable laws
• Not engage in any activity that interferes with or disrupts the Services
• Not attempt to gain unauthorized access to any part of the Services
• Not use the Services for any illegal or unauthorized purpose

5. Acceptable Use Policy

You must not use GenPixy's Services to:

• Violate any applicable law or regulation
• Engage in any illegal or harmful activities
• Infringe upon the rights of others, including intellectual property, privacy, or publicity rights
• Transmit, upload, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Engage in spamming, phishing, or other fraudulent or deceptive practices
• Attempt to probe, scan, or test the vulnerability of any system or network related to the Services

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this Acceptable Use Policy.

6. Responsible AI Usage

DrawGen creates narrated explainer videos from text topics. You must not request illegal, hateful, discriminatory, sexually explicit, or harmful content. Do not use videos to deceive, harass, or violate another person's rights.

Topic safety checks exist and stop creation when a safety decision is refused or unavailable. These checks do not guarantee that every output is accurate or appropriate. Review each video before sharing it. Disclose AI-generated content when required by law or platform policy. We may suspend or terminate access for violations.

7. Intellectual Property

7.1 Our Rights

• The Services and all related content are owned by GenPixy
• Our trademarks, service marks, and logos are protected by law

7.2 Your Content & Generated Content

• You retain ownership of the content you input and the content you generate using our Services ("Generated Content").
• You are solely responsible for the Generated Content, including ensuring it complies with these Terms, applicable laws, and does not infringe on any third-party rights.
• You grant us a limited license to use, store, process, and display your input content and Generated Content solely as necessary to provide, maintain, and improve the Services.

8. Credits, Prices, and Payments

• Credits: GenPixy services use credits. The Indonesian site calls credits "saldo". Credits are not money. You cannot withdraw credits, exchange them for cash, or move them to another account. Purchased credits do not expire.

• Top-ups: Available packs and prices are shown on the pricing page and in Billing. Check your currency and final total before paying. Polar is the merchant of record, which means it is the seller for purchases made through Polar. Credit packs are priced in USD. Polar handles payment, applicable sales taxes, and payment-related support. The final checkout total includes any applicable taxes. Polar Buyer Terms also apply. Refunds are processed through Polar under our Refund Policy, applicable law, and Polar’s terms.

• Credits are added only after payment is confirmed.

• Service prices: DrawGen shows the credit cost before you start a video. Free videos are limited to 3 per person per day, up to 60 seconds at 720p, while the 30 free videos for everyone that day last.

• GenPixy attribution: Free videos can include a GenPixy watermark and a short GenPixy end screen. Videos made with credits include neither.

• Reserved credits: Before a video starts, we reserve its credits. When the video fails or you cancel it, we return the reserved credits to your balance automatically.

• Price changes: Video credit costs may change over time. DrawGen shows the current credit cost before you start a video. A new credit cost applies only to videos started after the change. The pricing page shows current credit pack prices, which apply to new purchases.

• Refunds: The provider-specific Refund Policy applies to your purchase. Mandatory consumer rights remain unaffected.

8.1 Invite Program

• Who can invite: An eligible account can create one invite code and link on the Invite friends page. GenPixy decides in which countries new codes can be created and can change this at any time. Codes that already exist keep working unless they are paused.
• Who can join: An invite code applies only to an account that has not made a paid payment yet. Each account can use one invite code. You cannot use your own code, and one person must not create several accounts to use their own code.
• Bonus credits: When an invited friend pays for a credit top-up, the friend receives bonus credits equal to 20% of the credits of their first paid top-up. The inviter receives 20% of the credits of the friend's first paid top-up and 10% of the credits of each later paid top-up. Bonus credits are calculated from the amount actually paid after discounts, rounded down, and added right after the payment is confirmed. Bonus credits are credits under Section 8: they are not money and cannot be withdrawn, exchanged for cash, or moved to another account.
• Refunds and chargebacks: If a payment that produced bonus credits is refunded, partly refunded, or reversed through a chargeback or payment dispute, GenPixy removes the matching share of the bonus credits from both the inviter and the friend. This applies even when the credits were already used, so a balance can go below zero. While your balance is below zero, you cannot start paid videos until a top-up brings it above zero. By creating an invite code, you accept this rule.
• Fair use: Do not use spam, fake or duplicate accounts, misleading claims, paid ads that use the GenPixy name, or any other abuse to get invites. GenPixy can pause an invite code during a payment dispute or a review, refuse or remove bonus credits obtained through abuse, and suspend accounts that break these rules.
• Changes: GenPixy can change or end the invite program at any time. A change does not remove bonus credits that were already earned under the rules in force at that time, except under the refund, chargeback, and fair use rules above.

9. Limitation of Liability

To the maximum extent permitted by law, GenPixy shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Services.

10. Disclaimers

The Services are provided "as is" without any warranties, express or implied.

11. Termination

We may terminate or suspend your account and access to the Services under the following conditions:

• For All Users (including Free and Paid): Immediately and without prior notice for severe breaches, including but not limited to illegal activities, security threats, violations of intellectual property rights, violations of the Acceptable Use Policy or Responsible AI Usage guidelines, or activities that harm the integrity or availability of the Services.
• For Free Users: For any reason, including inactivity, at our sole discretion, without prior notice.
• For Paid Users: For reasons other than severe breaches mentioned above, we will provide at least thirty (30) days' written notice to your registered email address before terminating your account.

12. Amendments

• We reserve the right to modify this Policy at any time. Changes are effective upon posting on our website.
• Please review this Policy regularly. The "Effective Date" indicates the last revision.
